Terms & Conditions

1. Definitions

• "Whimbrel" / "We" / "Us": Whimbrel, a financial education practice registered in Bangkok, Thailand, operating at 12/8 Nang Linchi Road, Chong Nonsi, Yan Nawa, Bangkok 10120.
• "Service": The financial education programs and related materials offered by Whimbrel.
• "User" / "Participant": Any individual who enrols in a program, submits an enquiry, or accesses our website.
• "Agreement": These Terms & Conditions, as updated from time to time.
• "Program": A specific educational course offered by Whimbrel (Financial Numeracy Workshop, Property Ownership Cost Analysis, or Post-Divorce Financial Reorganization).

2. Acceptance of Terms

By submitting an enquiry, enrolling in a program, or using this website, you agree to be bound by these Terms. If you do not agree, please do not use our services. You must be at least 18 years of age to enrol in any Whimbrel program.

3. Description of Services

Whimbrel provides financial education programs conducted in small sessions at our Bangkok office (or remotely where agreed in advance). Programs are educational in nature and do not constitute financial advice, investment advice, legal advice, or any regulated financial service. Nothing in our sessions should be interpreted as a recommendation to buy, sell, or hold any financial product.

4. Enrolment and Scheduling

• Enrolment is confirmed upon receipt of payment and written confirmation from Whimbrel
• Sessions are scheduled by mutual agreement following enrolment
• We reserve the right to reschedule a session with reasonable notice (minimum 48 hours where possible)
• Participants wishing to reschedule must provide at least 24 hours' notice; shorter notice may result in forfeiture of that session

5. Payment Terms

• Program fees are quoted and payable in Thai Baht (฿)
• Full payment is due prior to the first session unless a written payment arrangement has been agreed
• Accepted payment methods will be confirmed at the time of enrolment
• Prices include all materials unless otherwise stated

6. Refund Policy

• Cancellation before first session: Full refund, less a ฿500 administration fee, if written cancellation is received at least five business days before the first session
• Cancellation within five business days of first session: 50% refund
• After first session has taken place: No refund for the completed session; remaining sessions may be refunded on a pro-rata basis at Whimbrel's discretion
• Refunds are processed within 14 business days

7. User Responsibilities

Participants agree to:

• Engage with sessions respectfully and in good faith
• Provide accurate information at enrolment
• Not record, reproduce, or distribute session content without prior written permission
• Use educational materials for personal reference only, not for commercial distribution

8. Intellectual Property

All materials provided as part of Whimbrel programs — including workbooks, calculator guides, and reference documents — remain the intellectual property of Whimbrel. Participants are granted a personal, non-exclusive, non-transferable licence to use these materials for their own reference. Reproduction, distribution, or sale of materials is prohibited without written consent.

9. Disclaimers

Whimbrel's programs are educational only. We make no representation that the content of any program will lead to any specific financial outcome. Participants remain solely responsible for their financial decisions. Information presented in sessions reflects our understanding of Thai financial structures and regulations as at the date of delivery; it should not be relied upon as current legal or tax advice.

10. Limitation of Liability

To the maximum extent permitted by Thai law, Whimbrel's liability for any claim arising from our services is limited to the fees paid for the relevant program. We are not liable for indirect, consequential, or incidental losses including loss of profit or loss of opportunity.

11. Confidentiality

Whimbrel treats personal financial information shared in sessions as confidential. We will not disclose session content to third parties except where required by law. Participants should note that sessions involving more than one participant mean that information shared may be heard by other attendees.

12. Termination

Whimbrel reserves the right to terminate a participant's enrolment with immediate effect if the participant behaves in a manner that is disruptive, disrespectful, or contrary to these Terms. In such cases, a partial refund for uncompleted sessions will be assessed at Whimbrel's discretion.

13. Dispute Resolution

In the event of a dispute, both parties agree to first attempt resolution through direct communication. If that fails, disputes will be referred to mediation before any formal legal proceedings. These Terms are governed by the laws of Thailand, and the courts of Bangkok shall have jurisdiction.

14. General Provisions

• Entire agreement: These Terms constitute the entire agreement between the participant and Whimbrel in relation to our services
• Severability: If any provision is found unenforceable, the remaining provisions continue in effect
• Waiver: Failure to enforce any provision does not constitute a waiver of that provision
• Assignment: Participants may not assign their enrolment without prior written consent

15. Changes to These Terms

We may update these Terms from time to time. Where changes are material, we will post a notice on the website. Continued use of our services following such notice constitutes acceptance of the updated Terms.
